This page explains the procedure for returning goods purchased from the modelis.lt online store, withdrawing from a distance sales contract, receiving a refund, and submitting a claim concerning defective or non-conforming goods.

The 14-day right to withdraw from a distance sales contract applies to consumers, meaning natural persons purchasing goods for personal, family or household purposes unrelated to their business, trade, craft or professional activity.
The 14-day right of withdrawal does not apply to legal entities or natural persons purchasing goods for business or professional purposes, unless otherwise agreed with the Seller in writing.
These terms do not restrict any mandatory consumer rights granted under the laws of the Republic of Lithuania or applicable European Union legislation.
A consumer has the right to withdraw from a purchase contract concluded through the modelis.lt online store within 14 calendar days without giving any reason.
The 14-day period begins on the day when the consumer, or a third party designated by the consumer other than the carrier, receives the goods.
Where several goods purchased under one order are delivered separately, the withdrawal period begins on the day when the final item is received.
To exercise the right of withdrawal, the consumer must clearly inform the Seller of the decision to withdraw from the distance sales contract before the expiry of the 14-day period.
A withdrawal request may be submitted using the following electronic form:

The consumer is recommended to provide:
full name;
order number;
the goods being returned;
the date on which the goods were received;
the email address to which confirmation should be sent.
The consumer is not required to provide a reason for returning the goods.
After receiving an electronic withdrawal request, the Seller shall promptly send the consumer confirmation of receipt, including the content of the submitted request and its date and time of submission.
After notifying the Seller of the withdrawal, the consumer must send or hand over the goods to the Seller no later than 14 calendar days after submitting the withdrawal request.

Goods may also be delivered to the above address in person after arranging the delivery time with the Seller by telephone or email.
When returning goods, the consumer is advised to:
use a traceable delivery service;
retain proof of dispatch;
package the goods properly to protect them against damage during transportation;
include the order number or a copy of the purchase document.
Cash-on-delivery shipments or shipments charged to the recipient will only be accepted if this method of return has been agreed with the Seller in advance.
Where goods of satisfactory quality are returned under the 14-day right of withdrawal, the consumer bears the direct cost of returning the goods.
Where the goods are defective, incorrect, or were damaged before being handed over to the consumer, the Seller shall cover reasonable return shipping costs. In such cases, the consumer should contact the Seller before dispatching the goods in order to agree on an appropriate method of return.
LiPo and other batteries, aerosols, paints, adhesives, resins, flammable liquids and other goods subject to carrier restrictions must be shipped in accordance with the relevant carrier’s safety requirements. The consumer should contact the Seller before returning such goods. This requirement does not restrict the consumer’s statutory right of withdrawal.
The consumer may inspect and test the goods only to the extent that would normally be permitted in a physical retail store in order to establish the nature, characteristics and functioning of the goods.
The consumer is liable for any reduction in the value of the goods resulting from handling beyond what was necessary to establish their nature, characteristics and functioning.
Returned goods should be:
clean and safely packaged;
complete with all parts, accessories and instructions;
free from mechanical, chemical or electrical damage caused by the consumer;
free from signs of use beyond what was reasonably necessary for inspection and testing.
The absence of or damage to the original packaging does not automatically remove the consumer’s right of withdrawal. However, damage to or loss of packaging may be considered when assessing a reduction in value if the packaging objectively forms part of the value of the goods or is necessary for their safe storage and resale.
The value of the goods may be reduced where, for example:
a model, kit or its components have been assembled, glued, painted, sanded, cut or drilled;
wires, connectors or electronic components have been cut, soldered or modified;
a combustion engine has been started using fuel;
an electric model, vehicle, aircraft or other device has been operated beyond what was necessary for inspection;
the goods have been programmed, reflashed or configured in a way that cannot be easily restored;
packaging containing paint, adhesive, resin, oil or another consumable product has been damaged, contaminated, partly used or mixed;
components, accessories, documentation or promotional items supplied with the goods are missing.
Any reduction in value shall be determined individually, based on the actual condition of the goods and the possibility of reselling them. A reduction in value shall not be applied automatically merely because the packaging has been opened.
The right of withdrawal does not apply in cases specified by law, including contracts for:
goods made according to the consumer’s individual instructions or clearly personalised for the consumer;
goods cut, engraved, 3D-printed or otherwise produced according to drawings, dimensions, inscriptions or other individual specifications supplied by the consumer;
materials that have been cut, shaped or otherwise irreversibly adapted according to non-standard specifications requested by the consumer;
goods that are liable to deteriorate or expire rapidly;
sealed goods which are not suitable for return due to health protection or hygiene reasons and which were unsealed after delivery;
sealed audio or video recordings or sealed computer software which were unsealed after delivery;
digital content not supplied on a tangible medium, where performance began with the consumer’s prior express consent and acknowledgement that the right of withdrawal would be lost once performance began;
other contracts excluded from the right of withdrawal under Article 6.228¹⁰(2) of the Civil Code of the Republic of Lithuania.
Selecting a standard colour, size, model or other option offered in advance by the Seller does not in itself mean that the goods were made to the consumer’s individual specifications.
These exceptions do not apply where the goods are defective or do not conform to the purchase contract.
The Seller shall refund all sums due to the consumer without undue delay and no later than 14 calendar days after receiving the consumer’s notice of withdrawal.
The Seller may withhold the refund until:
the returned goods have been received; or
the consumer provides reliable evidence that the goods have been dispatched,
whichever occurs first.
Where the consumer withdraws from the entire purchase contract, the Seller shall refund:
the price paid for the goods;
the cost of the least expensive standard delivery method offered by the Seller.
Where the consumer selected a delivery method more expensive than the least expensive standard delivery method offered by the Seller, the additional delivery cost shall not be refunded.
Refunds shall be made using the same payment method used for the original transaction, unless the consumer expressly agrees to another method and does not incur any additional costs as a result.
A reasonable and documented reduction in the value of the goods may be deducted from the refund.
The 14-day right of withdrawal and the consumer’s rights concerning defective or non-conforming goods are separate legal rights.
The Seller is responsible for any lack of conformity that existed at the time the goods were delivered and became apparent within the statutory legal guarantee period.
As a general rule, the statutory legal guarantee applies for two years from the date on which the goods were delivered. Where legislation provides for a longer period or an extension following repair, the longer period shall apply.
After discovering a defect, the consumer should notify the Seller no later than two months after the date on which the defect was discovered.
When submitting a claim, the consumer is recommended to provide:
the order number or another document confirming the purchase;
the name of the goods;
a clear description of the defect;
information about when and under what circumstances the defect became apparent;
photographs or video recordings, where these help to assess the problem;
the remedy requested by the consumer.
The consumer is initially entitled to request either repair or replacement of the goods, unless the selected remedy is impossible or would impose disproportionate costs on the Seller.
The consumer may be entitled to request a proportionate reduction in price or termination of the purchase contract where the conditions established by law are met, including where:
the goods have not been properly repaired or replaced;
the defect has reappeared;
the defect is serious;
it is clear that the Seller will not bring the goods into conformity within a reasonable period or without significant inconvenience to the consumer.
The purchase contract may not be terminated where the lack of conformity is minor.
Repair or replacement shall be carried out free of charge, within a reasonable period and without causing significant inconvenience to the consumer.
The Seller is not responsible for damage arising after delivery due to improper use, an accident or other circumstances beyond the Seller’s control.
Depending on the cause of the damage, such circumstances may include:
impact, dropping, crashing or collision damage;
damage caused by water, fuel, chemicals, dust or excessive temperature;
use of incorrect supply voltage, polarity, current or charging settings;
excessive discharge, improper charging or improper storage of a battery;
overloading of an engine, speed controller, servo or other component;
incorrect assembly, connection or installation;
unauthorised modification of the hardware, software or construction;
damage caused during soldering, cutting or other modification;
normal wear and tear or depletion of consumable components.
These circumstances do not release the Seller from liability where it is established that the specific defect existed at the time of delivery or is unrelated to the consumer’s actions.

The Seller shall examine the consumer’s request and provide a reasoned written response no later than 14 calendar days after receiving the request.
Where the consumer’s request is rejected or no response is received, the consumer may contact the State Consumer Rights Protection Authority of the Republic of Lithuania and submit a request through the Consumer Rights Information System, VTIS.
Before applying to a consumer dispute resolution authority, the consumer must first submit a written request or complaint to the Seller.
